According to a report found in January, 2012 at the website of the BBB of the Los Angeles, Orange, Riverside, and San Bernardino Counties of Southern California, in a 3 year period, 19 complaints were filed against Winn & Sims. Mostly all were for billing/collection issues.

At the Bud Hibbs website (http://www.budhibbs.com/bh/), between 2007 and 2010, several people reported unfair debt collection practices complaints against the law firm. The website also warns that, “Winn and Sims may be attempting to collect on debts that are likely bogus, time barred by statutes, which cannot meet legal verification requirements.”

    It is hard to gauge this from this review, but I am interested in whether or not you actually support law firms like Winn and Sims? Your review comes across as very objective, just laying out the facts, but as someone who is not having trouble with debt collectors (or debt at all); it is hard to gauge how the general public (myself included) should really feel towards law firms like this. Are they decent guys just doing there job? Is there a place for debt collectors in society, especially ones with a relatively good reputation (I mean, 17 complaints over 3 years is not too bad honestly)?

    I know you have much more background in law then myself, so it would be interested to hear what you have to say regarding these questions.

      You are right to say that Winn & Sims (Winn Law Group) does not have a bad complaint count. The online research indicates that compared to many other debt collection organizations, Winn & Sims has negligible complaints. Keep in mind that this blog periodically writes for our readers reviews on collection industry organizations. Obviously, the worse the debt collector’s practices, the more scathing the review.

      Pursuant to your question, “Is there a place for debt collectors in society?”, the emphatic answer is, “absolutely.” At the very least, borrowers are morally obligated to pay back their loans. No one should not weasel out from a financial obligation, especially if they have the means to pay. But, debt collectors are duly morally and legally obligated to engage in a practice that treats people with dignity and respect as opposed to employing brutally abusive debt collection schemes.

        Thanks so much for the response! Very interesting one at that as well. You touch heavily on philosophy and ethics of doing business. Personally, I would agree with you that debt collectors serve a purpose in society. Sometimes it is difficult to see where people fall considering the negative perspective we often have towards debt collectors as a result of some really, really bad ones here and there.

        Really, if a person is getting themselves into a lot of debt; they should expect debt collection calls and the like. However, as human beings, we should all expect some level of respect as well so long as the debtor is attempting to get the money back to the company.

        I just wish there was more empathy in the world for the situations people manage to get into, especially now with unemployment being so high and the economy not exactly looking like it will be getting better. It is really hard to take sides. I guess that’s (part of the reason) why I am not a debt collector myself.

    Winn & Simms now goes by “Winn Law Group APC”. They sent me a letter claiming I owed nearly $20,000 on an account with U.S. Bank. I immediately sent a letter clearly refuting the debt. I stated that I do not now have, nor have I ever had, a personal account with U.S. Bank, nor do I believe a personal account opened in my name exists at U.S. Bank, nor do I believe there is any account at U.S. Bank for which I am personally liable. (The debt appears to be a loan made to a now-defunct company, not to me, and the bank has never claimed that my name is on the account — nor have any of the three collection agencies that have tried to collect from the company. The bank did try to claim that I had signed a personal guarantee, but were unable to provide any loan docs at all, let alone ones with my signature as a guarantor.)

    It is good to hear of an ethical company that doesn’t try to break the law to collect on debt. What should people do if they receive one of these suits? Is that what you help with?

      We are not a law firm. However, there are law firms, which specialize in representing victims of unfair and abusive debt collection practices. You can Google an attorney or law firm with expertise in Fair Debt Collection Practices lawsuits. If you feel your rights have been violated by a debt collector, you can also report suspicious activity to the Federal Trade Commission and the Consumer Financial Protection Bureau.
